New Decision on Contracts from the Ministry of Trade!

The Ministry announced some amendments to the “Regulation on Contracts Established Outside the Workplace”, which was prepared by the Ministry based on the Consumer Protection Law No. 6502. With these amendments published in the Official Gazette, important steps have been taken to protect consumer rights.

In the Regulation; while some innovations have been introduced on issues such as prior information, mandatory content of the contract, and the right of withdrawal, the obligations of sellers and providers have also been increased. In addition, additional contact information that will enable consumers to reach the seller or provider faster has also become mandatory.

The statement made by the Ministry of Trade on its social media account is as follows; 

“The amendments made to the “Regulation on Contracts Established Outside the Workplace” issued based on Law No. 6502 on Consumer Protection entered into force after being published in the Official Gazette dated 23.08.2024 and numbered 32641. With these amendments, consumer protection regulations have been introduced in line with current needs and problems. With the relevant regulations, it is aimed to protect the economic interests of our consumers by including issues such as prior information, mandatory content of the contract, form requirement, right of withdrawal, and authorization certificate. Amendments have been made to the headings “Scope”, “Preliminary Information”, “Mandatory Content of the Contract”, “Exceptions to the Right of Withdrawal”, “Retention of Information” and “Application Conditions”, “Evaluation of the Application”, “Validity Period” and “Cancellation of the Certificate” in the Authorization Certificate section of the Regulation on Contracts Established Outside the Workplace; and additional obligations have been introduced for sellers and providers who sell outside the workplace. With the amendments made to the mandatory content of the contract established between the seller and the provider and the consumer, it has become mandatory to include additional contact information that allows the consumer to reach the seller and the provider quickly.
